These Terms of Service ("Terms") govern your access to and use of the managed SMTP and email infrastructure services provided by [SunSMTP — full legal entity name] ("SunSMTP", "we", "us"), including the websites at sunsmtp.com and my.sunsmtp.com (the "Service").

By creating an account, purchasing a plan, or using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you are authorized to bind that organization.

1. The Service

SunSMTP configures and provisions email-sending infrastructure on your behalf, including SMTP server setup, email application installation, authentication (SPF, DKIM, DMARC), DNS configuration, reverse DNS guidance, security hardening, and IP warmup. You operate the sending: you import your own lists, create your own campaigns, and are responsible for the messages you send. We provide the infrastructure and configuration; we do not author or control your campaigns or recipient lists.

2. Accounts & eligibility

You must be at least 18 years old and provide accurate, complete registration information. You are responsible for safeguarding your account credentials and for all activity under your account. Notify us promptly of any unauthorized use. We may require identity or business verification ("KYC") before provisioning, and may decline or revoke service where verification is not satisfactory.

3. Setup & access you provide

To configure your infrastructure, you may grant us access to your server (for example a VPS) and your DNS provider (for example Cloudflare). You represent that you are authorized to grant such access, and you remain responsible for the accuracy of the details you provide. You authorize us to make the configuration changes necessary to deliver the Service. We handle access credentials confidentially and in line with our Privacy Policy.

You are solely responsible for your sending and must comply with all applicable laws, including anti-spam and data-protection laws such as the CAN-SPAM Act, CASL, the GDPR/UK GDPR, and ePrivacy rules, wherever your recipients are located.

You may only send to recipients from whom you have appropriate permission or a lawful basis. You agree not to use the Service to:

We may monitor sending volumes, bounce and complaint rates, and reputation signals to protect the Service. Excessive bounces, spam-trap hits, or complaint rates may result in throttling, suspension, or termination. You agree to send responsibly during IP warmup and within your plan's limits.

6. Sending limits & reputation

Each plan includes a daily sending limit (for example, 10,000 emails per day on Ready To Go). Limits and IP warmup schedules exist to protect deliverability and reputation, including the reputation of your dedicated IP. We do not guarantee inbox placement, delivery rates, or that any message will avoid spam filtering, as these depend on factors outside our control, including your content, list quality, and recipient mail systems.

7. Suspension & termination

We may suspend or terminate your access, with or without notice, if you breach these Terms or the Acceptable Use Policy, if your sending threatens the security, integrity, or reputation of the Service, if required by law, or for non-payment. You may terminate by cancelling your subscription. On termination, your right to use the Service ends; we may delete your data after a reasonable period, subject to legal retention requirements.

8. Your content & data

You retain all rights to the lists, content, and data you provide ("Customer Data"). You grant us a limited license to host, process, and transmit Customer Data solely to provide the Service. You are responsible for the legality of your Customer Data and for having the necessary rights and consents. Our handling of personal data is described in the Privacy Policy, and where we act as your processor, a Data Processing Agreement applies.

9. Third-party services

The Service relies on and integrates third-party software and providers, including Postfix, Cloudflare, your VPS provider, and live-chat tools. Your use of those components may be subject to their own terms and licenses. We are not responsible for third-party services, and their availability may affect the Service.

10. Intellectual property

The Service, including our websites, branding, and original materials, is owned by SunSMTP and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service per these Terms. Open-source components remain governed by their respective licenses.

11. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation, specific deliverability or inbox-placement rates, or that the Service will meet your requirements.

12. Limitation of liability

To the maximum extent permitted by law, SunSMTP and its suppliers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability for any claim arising out of or relating to the Service will not exceed the amount you paid us in the [three (3)] months preceding the event giving rise to the claim.

You agree to indemnify and hold harmless SunSMTP from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your Customer Data, your sending activity, or your breach of these Terms or applicable law.

14. Governing law & disputes

These Terms are governed by the laws of [your jurisdiction — e.g. England and Wales, or the State of Delaware, USA], without regard to conflict-of-laws rules. The courts of [your jurisdiction] will have exclusive jurisdiction, unless mandatory consumer-protection laws provide otherwise.
